§ 16-58. Operating food-service vehicles near schools.

  • (1)

    For the purpose of this section:

    (a)

    "Food-service vehicle" shall mean any vehicle, including a wagon, trailer, motor vehicle and vehicle propelled by human power, in which ice cream, beverages, meat, bread or bakery products, or any other provisions intended for human consumption, are transported for retail sale from the vehicle, or for delivery to purchasers at retail.

    (b)

    "Operate" shall mean to sell or offer to sell or to deliver any article of food intended for human consumption, including, but not limited to, beverages, from a food-service vehicle.

    (2)

    It shall be a violation for any person to operate, or to cause or permit to be operated, a food-service vehicle within the right-of-way of any public street if within 1,000 feet of any school, public or private, located in the city, between the hours of 7:00 a.m. and 4:00 p.m. on any day in which school is in session. For the purpose of this section, the distance from a school shall be the straight air-line distance from the nearest point on the boundary of the school property.
